Safety supervision requirements for lifting appliances
Article 1 In order to strengthen the safety supervision of lifting machinery, prevent and reduce accidents of lifting machinery, and protect personal and property safety, these regulations are formulated in accordance with the Regulations on Safety Supervision of Special Equipment.
Article 2 The manufacture, installation, modification, maintenance, use, inspection and inspection and supervision and inspection of lifting machinery shall comply with these regulations.
The supervision and management of the installation and use of hoisting machinery for housing construction sites and municipal engineering sites shall be implemented in accordance with the provisions of relevant laws and regulations.
Article 3 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Supervision, Inspection and Quarantine) is responsible for the safety supervision of cranes nationwide, and the local quality and technical supervision departments at or above the county level are responsible for the safety supervision of cranes in their administrative areas.
Chapter II Lifting Machinery Manufacturing
Article 4 The manufacturing unit shall obtain the crane manufacturing license in accordance with the law before engaging in the corresponding manufacturing activities.
The lifting machinery manufacturing license implements hierarchical management, and the manufacturing unit shall have the corresponding conditions to obtain the manufacturing license, and the specific requirements shall be implemented in accordance with the relevant safety technical specifications.
Article 5 The validity period of the crane manufacturing license is 4 years.
The manufacturing unit shall submit a written application for license renewal 6 months before the expiration of the license; after review, the licensing department shall make a decision to approve or disapprove the license before the expiration of the valid period.
If the valid period of the lifting machinery manufacturing license expires and the license is not renewed, it is not allowed to continue to engage in lifting machinery manufacturing activities.
Article 6 The manufacturing unit shall adopt the hoisting machinery design documents that meet the requirements of the safety technical specifications.
Article 7 In accordance with the requirements of the safety technical specifications, the type test of hoisting machinery products and components, or the trial-manufactured new products and components of hoisting machinery, must be type tested for the complete machine or component.
Article 8 The manufacturing process of hoisting machinery shall be supervised and inspected by the inspection and testing agency at the place of manufacture in accordance with the scope, items and requirements specified in the safety technical specifications.
Article 9 The manufacturing unit shall manufacture the lifting machinery in the licensed place; however, if the structure cannot be disassembled and the transportation exceeds the limit, it can be manufactured at the site of use, and the inspection and testing organization at the place of the manufacturing site shall supervise it in accordance with the requirements of safety technical specifications and other requirements. test.
Article 10 The manufacturing unit shall not entrust all the main stressed structural parts (main beam, main and auxiliary boom, main support leg, standard section, the same below) to be processed or purchased and used in the manufacturing of hoisting machinery.
If the main force-bearing structural parts need to be partially processed or purchased, the manufacturing unit shall entrust the manufacturing unit with the corresponding type and level of lifting machinery qualifications to process or purchase the main force-bearing structural parts processed and used in the manufacturing of the lifting machinery.
Article 11 When hoisting machinery leaves the factory, it shall be accompanied by design documents (including general drawings, diagrams of main stressed structural parts, mechanical transmission diagrams and schematic diagrams of electrical and hydraulic systems), product quality certificates, installation and maintenance instructions, Supervisory inspection certificate, relevant type test qualification certificate and other documents.
Chapter III Installation, Modification and Maintenance of Lifting Machinery
Article 12 The installation, modification and maintenance unit of lifting machinery shall obtain installation, modification and maintenance permits in accordance with the law before engaging in corresponding activities.
The installation, modification, and maintenance permits of lifting machinery are managed in a hierarchical manner. The installation, modification, and maintenance unit shall have the corresponding conditions to obtain the installation, modification, and maintenance permits, and the specific requirements shall be implemented in accordance with the relevant safety technical specifications and other regulations.
Those engaged in lifting machinery transformation activities shall have the corresponding type and level of lifting machinery manufacturing capabilities.
Article 13 The validity period of the license for installation, modification and maintenance of lifting machinery is 4 years.
The installation, modification, and maintenance unit shall submit a written application for license renewal 6 months before the expiration of the license; after review, the licensing department shall make a decision to grant or disapprove the license before the expiration of the license.
If the license for installation, modification, and maintenance of lifting machinery expires and the license is not renewed, it is not allowed to continue to engage in the activities of installation, modification, and maintenance of lifting machinery.
Article 14 Units engaged in installation, renovation, and maintenance shall inform the quality and technical supervision department in accordance with the regulations, and construction can only be carried out after the notification.
For mobile cranes that need to be reinstalled, when they are installed in different places, they should be notified of the installation to the quality and technical supervision department of the construction site in accordance with the regulations before construction can be carried out.
The notification before construction should be in written form, and the content of the notification includes: unit name, permit number and contact information, use unit name and contact information, construction project, crane to be constructed, supervision inspection certificate number, type test certificate number, construction Location, construction plan, construction date, list of certified operators, etc.
Article 15 Units engaged in installation, renovation, and major maintenance shall apply for supervision and inspection to the inspection and testing agency where the construction is located before construction.
The inspection and testing agency shall conduct supervision and inspection at the construction site, and the supervision and inspection shall be carried out in accordance with the requirements of the corresponding safety technical specifications.
Article 16 The installation, modification, and maintenance unit shall transfer the technical data of the installation, modification and maintenance to the user within 30 days after the acceptance of the construction.
Chapter 4 Use of Lifting Machinery
Article 17 Before putting into use or within 30 days after putting into use, the user unit shall go to the registration department to register for use in accordance with the regulations.
For mobile cranes, the user unit shall go to the registration department where the property right unit is located to register for use.
Article 18 In the event of a change in the use unit of a lifting appliance, the original user shall go to the original registration department to cancel the use registration within 30 days after the change; the new user shall go to the local registration department to go through the use registration according to the regulations.
Article 19 If a lifting appliance is scrapped, the user unit shall go to the registration department to go through the cancellation of the use registration.
Article 20 Units using lifting appliances shall perform the following obligations:
(1) Use lifting appliances manufactured by a unit with corresponding license qualifications and passed supervision and inspection;
(2) Establish and improve the corresponding safety management system for the use of lifting appliances;
(3) Setting up a lifting machinery safety management agency or assigning full-time (part-time) safety management personnel to engage in lifting machinery safety management work;
(4) Carry out safety technical training for crane operators to ensure that they have mastery of operation skills and knowledge of accident prevention, and enhance safety awareness;
(5) Carry out daily maintenance of the main stressed structural parts, safety accessories, safety protection devices, operating mechanisms, control systems, etc. of the hoisting machinery, and make records;
(6) Equipped with rigging and spreaders that meet safety requirements, strengthen daily safety inspections and maintenance, and ensure the safe use of rigging and spreaders ;
(7) Formulate emergency rescue plans for crane accidents, establish emergency rescue teams as needed, and conduct regular drills.
Article 21 The user unit shall establish safety technical files for lifting machinery. The safety technical files of lifting machinery shall include the following contents:
(1) Design documents, product quality certificates, supervision and inspection certificates, installation technical documents and materials, instructions for use and maintenance;
(2) The type test qualification certificate of the safety protection device;
(3) Periodic inspection reports and periodic self-inspection records;
(4) Records of daily use status;
(5) Daily maintenance records;
(6) Operation failure and accident records;
(7) Use the registration certificate.
Article 22 The longest period of periodic inspection of hoisting machinery shall not exceed 2 years, and the inspection period of different types of hoisting machinery shall be implemented in accordance with the corresponding safety technical specifications.
The user shall submit an application for periodic inspection to the inspection and testing agency one month before the expiration of the period of validity of the periodic inspection.
If mobile cranes are used in different places, the user shall apply to the inspection and testing agency where it is used for regular inspection in accordance with the inspection cycle and other requirements, and the user shall report the inspection results to the registration department.
Article 23 The old hoisting machinery shall meet the following requirements before the user can put it into use:
(1) Possess the use registration cancellation certificate of the original user;
(2) It has the use registration certificate of the new user unit;
(3) Having complete safety technical files;
(4) Qualified for supervisory inspection and regular inspection.
Article 24 The leased and used unit of lifting appliances shall, in accordance with the provisions of Item (5) of Article 20 of these Regulations, carry out daily maintenance and records of the lifting appliances during the leased period of use, and be responsible for the safe use of the leased lifting appliances .
It is forbidden to rent and use the following lifting appliances:
(1) Failure to register for use in the registration department;
(2) There is no complete safety technical file;
(3) Substandard inspections or periodic inspections.
Article 25 The disassembly of hoisting machinery shall be carried out by a unit with corresponding installation permit qualifications.
Before lifting machinery disassembly and construction, a thorough disassembly operation instruction should be formulated, and construction should be carried out in accordance with the requirements of the demolition operation instruction to ensure the safety of the lifting machinery disassembly process.
Article 26 If a hoisting machine has one of the following circumstances, the user shall promptly discard it and take destruction measures such as disintegration:
(1) There are serious hidden dangers of accidents, and there is no value for renovation or maintenance;
(2) Reaching the design service life or scrapping conditions specified in the safety technical specifications.
Article 27 In the event of a failure or abnormality of a hoisting machine, the user unit shall stop using it, conduct a thorough inspection, and eliminate the failure and potential accidents before it can be put into use again.
Article 28 In the event of a crane accident, the user unit must report to the local quality and technical supervision department and relevant departments in a timely manner in accordance with the requirements of relevant regulations.
Chapter V Supervision and Inspection
Article 29 The quality and technical supervision department shall implement safety supervision on the manufacturing, installation, modification, maintenance, use, inspection and testing of lifting machinery in accordance with the “Regulations on Safety Supervision of Special Equipment” and these regulations.
Article 30 The safety supervisors and other administrative law enforcement personnel of the quality and technical supervision department shall be devoted to their duties, adhere to the principles, enforce the law impartially, and enforce the law in accordance with the law when engaging in safety supervision activities.
Article 31 The quality and technical supervision department shall report or notify the local people’s government and relevant departments in a timely manner if it needs the support and cooperation of the local people’s government and relevant departments to deal with the hidden dangers of lifting machinery accidents or illegal activities in the safety supervision work.
Article 32 The investigation and handling of safety accidents of hoisting machinery shall be carried out in accordance with relevant national regulations.
Chapter VI Legal Liability
Article 33 Anyone who violates the provisions of Article 6 of these regulations shall be ordered to make corrections and be fined between RMB 20,000 and RMB 30,000.
Article 34 If a manufacturing unit violates the provisions of Article 9 of these regulations and fails to manufacture lifting appliances in a licensed place, it shall be ordered to make corrections and be fined between RMB 20,000 and RMB 30,000.
Article 35 Anyone who violates the first or second paragraph of Article 10 of these regulations shall be ordered to make corrections and be fined 10,000 yuan up to 30,000 yuan.
Article 36 If a lifting machinery user unit is changed, and the original user unit violates Article 18 of these regulations and fails to go to the original registration department to cancel the use registration within 30 days after the change, it shall be ordered to correct and be sentenced to more than 2,000 yuan 2 Fines below 10,000 yuan.
Article 37 Those who use lifting appliances that do not meet the requirements of Article 23 (1) of these regulations shall be ordered to make corrections and be fined between RMB 2,000 and RMB 20,000.
Article 38 Anyone who violates the second paragraph of Article 24 of these regulations shall be ordered to make corrections and be fined between RMB 2,000 and RMB 20,000.
Article 39 Anyone who violates the second paragraph of Article 25 of these regulations shall be ordered to make corrections and a fine of less than 10,000 yuan shall be imposed.
Article 40 Anyone who violates other requirements of these regulations and constitutes an illegal act as stipulated in the “Regulations on Safety Supervision of Special Equipment” shall be punished in accordance with its regulations.
Article 41 If the safety supervisors of lifting machinery and other administrative law enforcement personnel abuse their powers, neglect their duties, or engage in malpractices for personal gains, they shall be investigated for legal responsibility in accordance with the law.
Chapter 7 Supplementary Provisions
Article 42 The lifting machinery mentioned in these regulations refers to the lifting machinery specified in Article 88 of the Regulations on Safety Supervision of Special Equipment, including its attached safety accessories and safety protection devices.
The specific categories (types) and varieties (types) of lifting appliances shall be implemented in accordance with the catalog approved by the State Council.
Article 43 The meanings of the following terms in these provisions are:
Renovation refers to the activity of changing the main force-bearing structural parts, main materials, main configuration, and control system of the original hoisting machinery, resulting in changes in the original performance parameters and technical indicators.
Maintenance refers to the repair activities that dismantle or replace the original main components, adjust the control system, replace the safety accessories and safety protection devices, but do not change the original performance parameters and technical indicators of the hoisting machinery.
Major maintenance refers to the maintenance activities that dismantle or replace the original main stressed structural parts, main configurations, and control systems, but do not change the original performance parameters and technical indicators of the hoisting machinery.
Article 44 The supervision and management of lifting machinery operators, inspection and testing institutions, and inspection and testing personnel shall be implemented in accordance with relevant regulations.
Article 45: The State Administration of Quality Supervision, Inspection and Quarantine is responsible for the interpretation of these regulations.
Article 46 These regulations shall come into effect on June 1, 2007.
